<p>Before you can incorporate a company in Canada, no matter what province or territory you live in, you will be required to provide some form of name search and as well, you might also be required to provide a name search to register a proprietorship, business name or a partnership.</p>
<p>Prior to obtaining a Nuans name search report or similar name search, a person who wishes to register a company, partnership, business name or sole proprietorship in Canada will sometimes do a preliminary name search. The preliminary name search weeds out all or most of the similarities to the proposed name. Less money will be wasted if you have this done.</p>
<p>The government reviews the full name search report to ensure there are no conflicts before it allows you to register your business. Some Canadian jurisdictions such as the federal jurisdiction will reject a name even if it sounds like another name and is spelled differently.</p>
<p>As part of the service of a search house, it is normal practice for the search house to do a preliminary name search as part of the service of ordering the full Nuans name search. It is important that you know in advance of ordering your name search that the preliminary name search is part of the service. If you do not require a name search to register as would be the case in some territories or provinces for partnerships, business names or sole proprietorships then you would need to pay separately for a preliminary name search. I will explain this further below.</p>
<p>There is no guarantee that a name is going to be accepted by a government just because you have a name search report for that proposed name. If a preliminary name search is not part of the service of the search house when you order a Nuans name search or similar search report then you should look for another search house. A Nuans search house has the ability to order a Nuans report without a pre-check of the name but a fully trained search house would never do so without a preliminary check of the name just to try and rule out any advance conflicts.</p>
<p>Look at it this way. A person wants to register a business called Morgan Cement Services Incorporated. The search company tells the person that there is no exact match because they do not have a policy of pre-checking names. There is actually a company registered called Morgan Cement Services Ltd. This person decides to register his business called Morgan Cement Services Incorporated and the owner of Morgan Cement Services Ltd. sees his flyers in the neighbourhood. Mr. Morgan of Morgan Cement Services Ltd. has had his business for many years and has built up a great reputation. Mr. Morgans reputation and longevity in the business gives him the ability to go court and request the court to get this person to change the name of his corporation. If you consider it, it would not be in your best interest either to have a name that is similar to another registered name.</p>
<p>The search house will provide the Nuans name search report or similar name search report to you by email and you should take some time to review the report to ensure for yourself that the name you wish to use is not too similar to another name already registered.</p>
<p>You can incorporate a company in Ontario that is different in any way. Considering the above example, the only difference is the ending of the name. Therefore it would be accepted. On the other hand if you were dealing with the federal government it would never be accepted for registration.</p>
<p>To register a business name, partnership name or sole proprietorship name in the provinces of Alberta or Ontario, and maybe in some of the other provinces and territories as well, you will not need a name search (Nuans report) to register. The governments in Alberta and Ontario do not check names prior to registering business names. The person registering the name must ensure themselves that the name is not already taken since they could still be taken to court if they pick a name that conflicts with another. As well, the Ontario government and the Alberta government will allow you to register a business name which is exactly the same as another business name already registered.</p>
<p>In this instance you would purchase a preliminary name search. To summarize when it is not a government requirement to provide a name search report (or Nuans) upon registering a sole proprietorship, partnership or business name a preliminary name search should be performed in advance of registering. You should also be aware that many search houses will provide you with a free preliminary name search if you purchase the registration of a sole proprietorship, business name or partnership with them in cases where a name search is not needed. If you are not clear on the websites policy, contact them and ask.</p>

<p>Once you find an attorney, before finalizing, you should think and rethink on whether he would be a suitable lawyer to handle your case. As law and order is a vast area still to be exploded, not all lawyers would be able to handle all the sectors. As there are attorneys specializing in specific areas you can as well hire a lawyer specializing the particular area in which your case falls in. </p>
<p>One of the best ways of to find an attorney for your need is to use the traditional word of mouth advertisement. Start telling your friends and colleagues whom you can trust about your need. If you really do not have a case that you can fight and win then your attorney should be able to tell you the truth and advise you on alternative ways of resolving the issue. </p>
<p>You can also find an attorney through online directories. You will be able to get information about a number of good lawyers who focus on specific areas of law through these directories. It will be rather easier to find an appropriate lawyer who will be suitable for your need. </p>
<p>When you try to find an attorney, make sure that you short list more than one lawyer before you make your decision. You might be interested to find an attorney who is associated with a law firm or you might prefer a lawyer who operates independently. If you would like to find an attorney who operates independently, you must pay extra attention to verify the credentials and the success rates of the lawyer.</p>
